Terms and Conditions and Customer Information
(Status: May 2025)
1. Scope
I. These Terms and Conditions apply to all business relationships between you and us, AkibaDreams GmbH, legally represented by the managing directors Benjamin Schulte, Andreas Degen, and Vincent Freudenreich, Siemensstr. 1, 53121 Bonn, Germany (hereinafter referred to as the “Company”), concluded via the website www.harajukudreams.de.
AkibaDreams GmbH offers this website, including all information, tools, and services available from this site, to you, the consumer, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By agreeing to these Terms and Conditions, you confirm that you are at least of legal age in your country of residence, or that you are of legal age and have given us your consent to allow any of your minor dependents to use this website.
II. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
A business or entrepreneur is a natural or legal person or a legally recognized partnership who, when entering into a legal transaction, acts in the exercise of their trade or profession.
For business customers: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; such terms shall only become part of the contract if we have expressly agreed to them in writing.
2. Contractual Partner, Conclusion of Contract, and Correction Options
The purchase contract is concluded with AkibaDreams GmbH.
By placing products in our online shop, we make a binding offer to conclude a contract for those items.
You may place our products into the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process.
The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by e-mail.
Note on Pre-Orders:
Certain products are offered as pre-orders (“Pre-Orders”), which are clearly indicated in the shop. The contract for such items is also concluded by clicking the order button. Delivery will take place at a later date specified in the product description. By placing the order, you expressly agree to the later delivery.
3. Contract Language and Storage of Contract Text
The language available for the conclusion of the contract is German.
We store the contract text and will send you the order details and our Terms and Conditions in text form. The contract text can be viewed in your customer login account.
4. Shipping Costs and Delivery Conditions
I. The delivery terms, delivery date, and any existing delivery restrictions can be found on the respective page of our website or in the relevant product description.
II. In addition to the stated product prices, shipping costs apply. The applicable shipping costs are displayed on the company’s website and are clearly shown to the customer before the order is submitted.
In the event of a partial return, the original shipping costs will not be refunded. A refund of shipping costs will only be made if all items in the order are returned in full.
III. For deliveries of goods to countries outside Europe, import duties may apply, which must be borne by the customer. The amount of import duties varies in different customs territories. The customer is responsible for the proper payment of all necessary customs duties and fees.
We deliver within the European Union and, by arrangement, to Switzerland and the United Kingdom. Please note that additional costs (e.g. customs duties, import VAT, or bank transfer fees) may apply for deliveries to non-EU countries. These charges are not levied by us and must be paid directly to the relevant customs or tax authorities. Further information can be obtained from your local customs office.
IV. Delivery will be made to the delivery address provided by the customer during the order process. If the customer or recipient specifies an alternative drop-off location with the delivery service, the risk of loss or damage passes to the customer once the parcel has been delivered to that location.
V. Unless otherwise stated, goods will be dispatched within 3–5 working days after receipt of payment. Standard delivery times are 2 working days within Germany and 3–7 working days for other European countries. Delivery does not take place on Sundays or public holidays.
VI. For orders containing multiple items with different delivery times, the shipment will generally be made together unless otherwise agreed. In this case, the delivery time is determined by the item with the longest delivery period.
VII. For pre-orders (“Pre-Orders”), delivery will not occur immediately after payment but at the time specified in the product description. The stated delivery time is non-binding; however, we strive to deliver as soon as possible once the item becomes available. If delivery is delayed, the customer will be notified promptly by e-mail.
5. Payment
The following payment methods are generally available in our shop:

Credit Card
Your card will be charged immediately upon completion of the order. -
Amazon Pay
Payments are processed via Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg (Amazon). You must have an Amazon account, log in with your credentials, and confirm the payment instruction. -
Apple Pay
Payments are processed by Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (Apple). You must use the Safari browser, have Apple Pay activated, and confirm the payment. -
Google Pay
Payments are processed by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (Google). You must have Google Pay activated and confirm the payment. -
Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (Klarna), we offer several payment options, such as “Pay Later.” Payments via Klarna are available only for consumers and require a successful address and credit check. Further information is available during checkout. -
Purchase on Account via Klarna
The invoice amount is due 14 days after dispatch of the goods and receipt of the invoice. -
PayPal / PayPal Express
Payments are processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (PayPal). You must have a PayPal account and authorize the transaction.
The prices displayed for the products are total prices including statutory VAT (currently 19%) and all other price components, excluding delivery and shipping costs.
For pre-orders, payment is due immediately upon order. Payment must be made in advance even if delivery takes place at a later date. Your statutory right of withdrawal remains unaffected.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the Withdrawal Policy.
Goods that can normally be returned by post (including parcel services) must be returned without undue delay and in any event no later than fourteen days from the day on which the consumer notifies the company of the withdrawal. The deadline is met if the goods are sent before the fourteen-day period expires.
Return shipments must be sent only to the following address:

Please do not send returns to the business address of AkibaDreams GmbH in Bonn.
Consumers bear the direct cost of returning the goods.
7. Transport Damage
For business customers: The risk of accidental loss or deterioration passes to you once we have handed the goods over to the carrier, freight forwarder, or other party designated to carry out shipment.
8. Warranty and Guarantees
8.1 Statutory Warranty
Unless expressly agreed otherwise, statutory warranty rights apply.
Consumers are asked to check the goods upon delivery for completeness, obvious defects, or transport damage, and to notify us and the carrier as soon as possible of any complaints. Failure to do so does not affect your legal warranty rights.
Where a characteristic of the goods deviates from objective requirements, such deviation shall only be deemed agreed if you were informed of it prior to contract conclusion and it was expressly and separately agreed between the parties.
The following limitations and reductions in limitation periods do not apply to claims arising from damage caused by us, our legal representatives, or agents:

injury to life, body, or health

intentional or grossly negligent breach of duty

fraud or deceit
-
breach of essential contractual obligations (cardinal duties)

warranty promises (if applicable)

where the Product Liability Act applies
For business customers: Only our product descriptions and those of the manufacturer included in the contract are binding regarding the quality of goods. Public statements or advertising claims of the manufacturer are not binding. For entrepreneurs, the limitation period for defect claims for newly manufactured goods is one year from transfer of risk.
The statutory limitation periods for recourse claims under § 445a BGB remain unaffected.
For merchants, the obligations under § 377 HGB (duty to inspect and report defects) apply. Failure to give such notice results in acceptance of the goods, unless the defect was not discoverable during inspection or we have fraudulently concealed it.
8.2 Guarantees and Customer Service
Information about any applicable guarantees and their specific conditions can be found in the product descriptions or on special information pages in the online shop.

9. Retention of Title
I. The goods remain the property of the company until full payment has been received.
II. For business customers, the goods remain our property until all claims arising from the business relationship have been settled.
III. The customer must inform the company immediately of any seizure or other interference by third parties with the goods subject to retention of title.
10. Liability
We are fully liable for claims resulting from damages caused by us, our legal representatives, or our agents:

in case of injury to life, body, or health

for intentional or grossly negligent breaches of duty

under warranty commitments

where the Product Liability Act applies
In case of breach of essential contractual obligations (cardinal duties) due to slight negligence, our liability is limited to the foreseeable damages typical for this type of contract.
All other claims for damages are excluded.
11. Data Protection
I. The company undertakes to treat customers’ personal data confidentially and in compliance with statutory data protection provisions. Data is collected, processed, and used solely for the purpose of fulfilling the contract and in accordance with applicable laws. Personal data will only be disclosed to third parties as part of the contract’s execution.
II. Customers may request information about their stored personal data at any time. Requests for deletion of data can also be made at any time within the framework of statutory obligations. Further details are provided in our Privacy Policy.
12. Code of Conduct
We have not submitted to any specific code of conduct.
13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://consumer-redress.ec.europa.eu
We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.

14. Protection of Minors
For orders of age-restricted goods, age verification will be carried out upon delivery. Delivery to parcel lockers (Packstationen) is not possible.
15. Final Provisions
I. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
II. For merchants, the exclusive place of jurisdiction is the company’s registered office.
III. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
